EDUCATION

Law degree, Summa Cum Laude (J.D. equivalent) from the Facultad Libre de Derecho de Monterrey (2001).

PRACTICE AREAS

Gibrán Marceau represents clients in a wide range of business litigation and dispute resolution procedures before the Mexican Federal and State Courts, with an emphasis on corporate disputes and complex civil and commercial matters.


He focuses his practice on general corporate matters including commercial transactions, joint ventures, corporate governance advice and has participated in the implementation of the legal framework for mergers and acquisitions.


In addition, since 2008 Mr. Marceau Barragán is authorized by the Superior Court for the State of Nuevo León to act as an official translator (English-Spanish languages).

PROFESSIONAL EXPERIENCE

·       Represented and counseled clients from México and abroad before the Mexican Courts during all phases of judicial proceedings, which on occasions have included several jurisdictions. Such proceedings have included complex corporate disputes, insolvency procedures, matters in which the clients were leaders in their respective lines of business within México (telecommunications, sugar processing, logistics, computers, steel, tool manufacturing, textile industry, medical services, real estate, consulting services and aviation, among others). Also, Mr. Marceau has counseled clients with respect Mexican law and in connection with arbitral proceedings held in the United States of America.

·       Counseled clients from México and abroad in order to prevent litigation contingencies arising either from their day to day activities or from business transactions such as joint ventures or the acquisition of equity or assets.

·       Served as “expert witness” in connection with Mexican civil and procedural law within litigation recently conducted in the State of Texas, United States of America.

·       Counseled and represented clients in connection with the negotiation and implementation of business transactions, such as the acquisition of shares or assets, joint ventures, corporate restructuration and mergers and acquisitions, among other civil and commercial agreements.

·       Currently serves in the capacity of official translator, authorized by the Superior Court of Nuevo León (English-Spanish languages) to be presented before Mexican or abroad authorities.
